Sobre a garota estuprada no Rio de Janeiro

Que pena que o nosso Brasil é tão machista, tão racista, tão preconceituoso. Você pode dizer: Não é bem assim! É bem assim e muito mais. É só prestar atenção nas nossas brincadeiras. O quanto brincamos com piadinhas em torno do sexo e rimos com a deficiência física, fazendo trocadilhos, e denegrimos qualquer pessoa que não está em concordância conosco. Este Fantástico foi fantástico. Pela primeira vez as mulheres se mobilizaram intensamente, 800 comunicações ao Ministério Público de Polícia, denunciando o estupro que desta vez ganhou dimensão internacional. O mundo se escandalizou com nossa mentalidade permissiva, porque publicar em redes sociais uma garota sendo dopada, machucada no corpo e na alma, por alguns 33 homens animais, que representam a nossa porcentagem máxima de machismo é de doer, é de chorar. As redes sociais começam a aproveitar a mesma oportunidade de destruir para construir. A solidariedade em torno das mulheres que sofrem esta maldição como resultado da cultura do estrupo.Que o código Penal do Brasil possa agir desta vez a favor da garota. E não adianta me dizer que a garota andava com bandidos. Até na cadeia bandido estuprador levar a pior dos colegas. Basta provar! Acho que se tirássemos um Raio X Espiritual destes homens, portariam um rabo bem comprido como acabamento da coluna lombar. Animais!

O convite não é do candidato propriamente dito, mas de um governo paralelo. E o convite não aceito transforma-se em Café Indigesto no Jornal TBN de condado. Personalidade complicada, bipolar, mandona e obsessiva. Só pensa no poder. Autoritarismo Indigesto eu diria. Vá gostar de mandar em macho lá no inferno. Aqui não tem pra você não mandão.

A consequência do Suborno é Prejudicar a Operação Lícita

Jorge pontual entrevistou a A professora Susan Rose-Ackerman para o Programa Millenium da Globo News

A economista americana e  professora da escola de Direito da Universidade Yale, nos Estados Unidos, é uma das maiores estudiosas da corrupção no mundo e uma referência global no assunto. Autora do livro Corrupção e governo. A corrupção age na esfera pública, com um ponto de vista de economista:

“Eu analiso a corrupção como se fosse uma transação econômica em que parece uma transação comercial comum, só que feita num contexto de violação de regras, induzindo alguém a fazer algo que vai contra suas responsabilidades profissionais, políticas e oficiais”.

Para Susan Rose-Ackerman, os políticos podem se tornar corruptos, e são pessoas que podem ter comportamento influenciado pelas oportunidades que surgem, usando dinheiro próprio para seu benefício obtendo favores especiais, mas a pessoa não é qualificada para ocupar o emprego ou obter um contrato específico. Em consequência o suborno prejudica as operações lícitas. E quando pensamos sobre oportunidades para a corrupção precisamos pensar onde está a vantagem que alguém pode levar pagando a propina, por exemplo.

A reforma estrutural deve ser a primeira linha de ataque na corrupção se um programa não serve ao seu público. O remédio é a eliminação não a reforma. Uma das consequências da corrupção é a desigualdade. Quanto mais corrupto um país, maior a desigualdade social.

As pessoas no topo querem preservar a sua posição e uma das formas de fazerem isso é usarem sua riqueza para corromper a classe política e se manter no poder. O sistema muito corrupto retira recursos da economia produtiva, das atividades produtivas produzindo níveis baixos de crescimento, prejudicando a população mais carente.

Grandes obras públicas existem muitas vezes para criar propinas e aí, a saúde, educação e serviços públicos são deixados de lado porque o estado se concentra nesses grandes projetos. Claro que há obras que são elefantes brancos, são grandes, dramáticas e inúteis, fáceis de identificar. Os casos mais complicados são aqueles em que existe uma justificativa para construir uma ponte, reformar um porto ou construir uma estrada. A corrupção entra na decisão sobre a empresa que fiará com o contrato, no desenvolvimento do projeto. Ele poderá ser exagerado demais, luxooso demais, e principalmente muito incomum e especial. Um projeto muito diferente de todos os outros fica difícil para os auditores externos verificar se foi superfaturado ou não por qualidade única. Grandes projetos de infraestrutura incomum podem ficar difícil para os auditores externos, mesmo de grandes firmas avaliar se foram superfaturados. E quando há excesso de lucro, pode haver uma disputa pública das empresas para dividirem parte destes lucros. Eu participei como consultora de uma empresa de investigação de Quebec que investigava esse tipo de corrupção. Era um esquema bem antigo de um grande grupo político que passou muito tempo no poder. Uma dúvida era essa: como durou tanto tempo? As pessoas deviam saber que ela existia. E o que mais me preocupou e interessou nesse caso, foram todos os profissionais, os advogados, os contadores, e os arquitetos que imagino fossem relativamente honestos, e que se tornaram não particularmente corruptos, mas eles ganharam as concorrências e não denunciavam o esquema. No seu livro, pergunta Pontual, há uma referência especial ao Brasil no seu ministério público. Explique o que você pensa disso. Me diz, no Brasil existe uma independência exagerada da Procuradoria Pública?

Eu acredito apenas pelo que leio nos jornais, que os procuradores do Brasil, realmente são independentes. E me parece que a Controladoria Geral da União também é bem independente e fez auditorias aleatórias de prefeituras que também acho útil.  Alguns outros países também têm controladorias ou outras agências independentes, mas acho louvável a independência dos procuradores e o fato de que eles conseguiram não se envolver. Acho que a Itália tem algo semelhante, que vocês copiaram até certo ponto.

Na Itália a operação Mãos Limpas teve muito sucesso inicialmente, mas depois disso novas leis surgiram com a chegada de Berluscone no poder.

Como evitar esse tipo de obstrução depois de uma longa investigação?

Uma das decepções da Operação Mãos Limpas da Itália foi que, por um lado as pessoas ficaram com tanto medo de serem presas que não tiveram apoio suficiente para se comportar honestamente.  E, por outro lado, algumas reformais legais não ocorreram. Parte dos problemas é que os procuradores são apenas uma das peças dos quebra cabeças. Eles podem revelar e ajudar a entender o que acontece, e no Brasil penso que há duas questões: Uma delas tem a ver como o sistema legal funciona e com problemas desse sistema e com problemas desse sistema. A outra questão é revelar fraquezas das partes da estrutura governamental, como talvez financiamento de campanhas, infraestrutura.... Parece que na Itália os problemas são grandes obras de infraestrutura.

Como esse processo funciona e porque é tão vulnerável? Obviamente é sempre uma área de risco, mas o que pode ser feito para reformar um setor específico que sofre com a corrupção? Não são os procuradores que deveriam fazer isso. São pessoas de dentro do governo que têm de pensar formas de reduzir os incentivos. Uma crítica comum, diz. Pontual, é que talvez os procuradores sejam independentes demais, não há supervisão, eles não são eleitos e não poderiam agir de forma democrática.

É preciso contratar pessoas através de exames de seleção, ou através de outro processo meritocrático, com muita transparência e comunicado às pessoas. O mais importante que sejam grupos de profissionais e independentes. A outra questão tem a ver com a interação entre procuradores e tribunais, porque são procuradores e não agiriam sozinhos.
